Did you know that the 5th amendment specifically speaks about NOT incriminating themselves? Before you run around spouting off "rights", at least understand them. You are correct, you do not have to be a US Citizen to be in the country, which is why they do not ask an incriminating question. If you answer no, they will check to see if you are here legally. Answering YES or NO does not incriminate yourself, therefore, not violating your constitutional right.

2.) Rodney King was on PCP. The officers involved in the incident were wrong, yes, but Rodney King did lead them on a long pursuit. That was 16 years ago, dude.
3.) What the fuck? Changeling? That's a fucking MOVIE. It's fictional and doesn't even take place in this time period.

Actually, I think it is you that was proven wrong. You never did provide a cite to a litigated law giving DHS power to detain people without probable cause at a temporary checkpoint. You also did not provide a cite to a litigated law giving DHS power to force a person to answer questions.
It looks like you are right about the "American Border Patrol" being civilian ran.

You ARE required to identify yourself to law enforcement. This is common knowledge. You are identifying your citizenship to the officer, and they CAN detain you if they cannot ascertain who you are.
The question "Are you a US citizen?" does not incriminate yourself, like I've said many times. The 5th Amendment specifically speaks about double jeopardy, witnessing against yourself and such, and the one you're talking about "not be held to answer for a capital, or otherwise infamous crime..."

They never asked him to identify himself so your statement is irrelevant.
My statements stand. ou never did provide a cite to a litigated law giving DHS power to detain people without probable cause at a temporary checkpoint. You also did not provide a cite to a litigated law giving DHS power to force a person to answer questions.

Identifying your citizenship IS identifying yourself. That's one of the things officers check for when in a vehicle stop.
I cited the fucking 5th amendment, word for word. Also, DHS did NOT detain him. Don't try to interpret something you will never understand.

INA287(a)(1) ...( 2 weeks ago by nicklsouza)
INA287(a)(1) provides authority to agents to question any alien or person believed to be an alien as to their right to be or remain in the U.S. INA287(a)3 provides authority to stop and board any vehicle within 100 air miles of the external boundary of the U.S. United States v. Martinez-Fuerte has ruled that suspicionless stopping of all vehicles at a properly sited (within 100 air miles) immigration check point is constitutionally reasonable.
Yes your are being ...( 2 weeks ago by nicklsouza)
Yes your are being detained at a checkpoint, a detention is any obsturuction to your freedom to go about your business. The more important question is if the detention is reasonable in the eyes of the constitution. Since immigration statutes are in place giving agents authority to stop and question any vehicle within 100 miles of the border and the supreme court has upheld this authority, I'd say you are mistaken in thinking internal checkpoints are illegal.

SCOTUS on INA287:
"Our prior cases have limited significantly the reach of this congressional authorization, requiring probable cause for any vehicle search in the interior and reasonable suspicion for inquiry stops by roving patrols. Our holding today, approving routine stops for brief questioning is confined to permanent checkpoints. We understand, of course, that neither longstanding congressional authorization nor widely prevailing practice justifies a constitutional violation"

The Supreme Court struck down several long standing BP practices as illegal in the 1970's. Martinez-Fuerte was decision #4 where the BP was thrown a bone after being ruled against in Ortiz, Brignoni-Ponce and Almeida-Sanchez (see quote below).
In the last case, the court only upheld the permanent checkpoint's legality in cases where it is limited in scope to brief immigration checks and any further detention or search is based upon consent or probable cause.

"the court only upheld the permanent checkpoint's..." That is a pretty good definition of what a check point is and does. Primary= brief imm. checks. If suspicion is aroused via officer observation, a vehicle is sent to primary. Any searches that take place there are based on consent or pc from open view observation. once imm. status is established the occupants are either free to go or arrested. You don't have to answer questions or provide id as at this point it is a consensual encounter.
